1. Acceptance of Terms

Welcome to Snackly (formerly CaloAI). By accessing or using the Snackly mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Snackly is a nutrition tracking and meal analysis application that uses artificial intelligence to:

  • Analyze food images and estimate nutritional content
  • Track daily calorie and nutrient intake
  • Provide personalized nutrition recommendations
  • Monitor progress toward health goals

3. User Accounts

3.1 Account Creation

  • You must create an account to use the App
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 13 years old to create an account

3.2 Account Security

  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • We are not liable for any loss or damage arising from your failure to protect your account

3.3 Account Deletion

  • You may delete your account at any time through the App settings
  • Upon deletion, your personal data will be permanently removed or anonymized
  • Active subscriptions will be handled according to the subscription terms
  • Deletion is permanent and cannot be undone

4. Subscriptions and Payments

4.1 Subscription Plans

  • Snackly offers both free and premium subscription plans
  • Premium features include unlimited scans, AI nutritionist, advanced analytics, and premium support
  • Subscription prices are clearly displayed in the App

4.2 Free Trial

  • New users may receive a free trial period for premium features
  • You will be charged when the trial period ends unless you cancel
  • Cancel anytime during the trial to avoid charges

4.3 Billing and Renewal

  • Subscriptions are billed through Apple In-App Purchases
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the current period ends
  • Your Apple account will be charged within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your Apple account settings

4.4 Refunds

  • Refund requests are handled by Apple according to their policies
  • Contact [email protected] for refund assistance

4.5 Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You will retain access to premium features until the end of the paid period

5. Medical Disclaimer

5.1 Not Medical Advice

  • Snackly provides nutritional information and tracking tools for general wellness purposes
  • The App is NOT a substitute for professional medical advice, diagnosis, or treatment
  • Always consult a qualified healthcare provider before starting any diet or nutrition program
  • Do not disregard professional medical advice or delay seeking it because of information from the App

5.2 AI Limitations

  • AI-generated food analysis and nutritional estimates may not be 100% accurate
  • Values are approximations based on visual analysis and databases
  • For precise nutritional information, refer to product labels and verified sources
  • The App should be used as a general tracking tool, not a precision measurement device

5.3 Health Conditions

  • If you have diabetes, eating disorders, allergies, or other medical conditions, consult your healthcare provider before using the App
  • The App is not designed to diagnose, treat, cure, or prevent any disease

6. User Content and Data

6.1 Your Content

  • You retain ownership of photos, data, and information you submit to the App
  • You grant us a license to use your content to provide and improve our services
  • You represent that you have the right to submit all content you upload

6.2 Privacy

  • Your use of the App is subject to our Privacy Policy
  • We collect and use data as described in the Privacy Policy
  • We implement security measures to protect your personal information

6.3 Data Accuracy

  • You are responsible for the accuracy of information you input
  • We are not responsible for errors in manually entered data

7. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer or decompile the App
  • Use the App to harass, abuse, or harm others
  • Create multiple accounts to abuse free trials
  • Share your account credentials with others

8. Intellectual Property

8.1 Our Rights

  • The App, including its design, features, and content, is owned by Snackly and protected by copyright and trademark laws
  • Our logos, trademarks, and brand features are our property
  • You may not use our intellectual property without written permission

8.2 Feedback

  • If you provide feedback or suggestions, we may use them without obligation to you
  • You grant us a perpetual, worldwide license to use any feedback you provide

9. Third-Party Services

  • The App integrates with Apple services (sign-in, in-app purchases, notifications)
  • The App uses Google Cloud services for AI processing and storage
  • Third-party services are governed by their own terms and privacy policies
  • We are not responsible for third-party services or their content

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
  • WE DO NOT GUARANTEE THE APP WILL BE ERROR-FREE OR UNINTERRUPTED
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
  • WE ARE NOT LIABLE FOR HEALTH OUTCOMES OR DECISIONS BASED ON APP DATA

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of others
  • Content you submit to the App

12. Changes to Terms

  • We may modify these Terms at any time
  • We will notify you of material changes through the App or by email
  • Continued use of the App after changes constitutes acceptance
  • If you don't agree to changes, stop using the App and delete your account

13. Termination

13.1 By You

  • You may terminate your account at any time through account deletion
  • Termination does not entitle you to a refund unless covered by our refund policy

13.2 By Us

  • We may suspend or terminate your account for violations of these Terms
  • We may terminate accounts for fraudulent activity or abuse
  • We reserve the right to refuse service to anyone

17. App Store Terms
